  • Floridians just ought to allow the Russian and Japanese Mafia to infuse lots of cash back into Florida real estate to fix our economy. It’s the same rationale currently taken by the Floriduh insider corporatists. A State run by fraud will never survive economically because investors will be to scared to buy here for lack of due process and property rights. This is the end of “democracy” in our Country if this lousy bill passes.

Excellent analysis of this version of HB213; I learned a lot. Thank you Attorney Weidner!

My understanding is this bill still needs to go to the Judicial Committee. Will not the comments you make regarding over-stepping of the legislative on the judiciary and other unconstitutional parts of this bill be changed there?

The process of bringing a bill to the full floor for vote including changing of language specific to a committee’s “expertise” DOES NOT mitigate the unconscionable behavior of our elected officials that drafted this legislation that tramples our rights to due process, provides windfall for foreclosure attorneys, and puts financial responsibility for the financial and housing crises on the backs of struggling citizens. Outrageous!

  • Please support the ONLY candidate running against Passidomo – Peter Richter! http://www.electRichter.com I strongly oppose this backdoor bank bailout that she is trying to pass.

BTW: Did anyone notice that provision in this bill that makes it so that banks no longer need to show the physical mortgage to the court? If this bill passes, it will only be required to show an affidavit that some bank employee has seen the note! More attention needs to be called to this!

Here is what I sent to the reps I could find in my area…

    Mr Bennett:

The first person I ever voted for was Ronald Reagan and ever since, I have voted Republican. I understand the Florida “Fair” Foreclosure act is coming up for a vote. If you decide to vote for this bill, the next election will cause me, for the first time since I was 18, to vote for a democrat. This is stripping away the rights this state and country has had since before you and I were a twinkle in our dad’s eye. I have read the bill from start to finish and this is just wrong. You cannot justify letting the servicers (who identify themselves as the banks) to screw homeowners and the TRUE investors who put op the money for the loans/mortgages out of their rights. The reason foreclosures takes so long in Florida has more to do with the fact their paperwork was manufactured by companies (at the “banks” direction) like DocX and now they are looking for another way to take homes, they don’t have an interest in (other than the servicing) so they can sell them and screw the investors who really put the money up in the first place. Did you miss the 160+ count indictment Missouri filed against DocX last week? Since we are the biggest foreclosure state, how much of their rubbish is filled in every county in the state. It corrupts any chain of title for ALL (not just the foreclosures) properties in the state.

If speeding up forlosure is the aim then yo uhave to come to the realization, government can’t do everything. The reason they take so long is they do not own the loans, the loans have already been paid off by way of TARP or AIG default swap payouts. The “banks” that would be greenlighted for foreclosure don’t even have legal standing in many cases to bring the foreclosure. It would be like me foreclosing on your house, if you didn’t defend it I would get YOUR house. Look at Countrywide’s SEC filings. 99% of their loans were sold to Fannie or Freddie or private investment pool like Grenwich Financial. They all have pending litigation agains Countrywide/Bank of American because they are also not receiving payments due.

Look into it for yourself. There is only one conclusion. These “banks” are getting free houses. Voting for this bill means you are supporting the biggest transfer of wealth from the citizens of this country to the banks. Make the correct decision and vote “No.” I intend to check your vote on this bill and will adjust my vote based on your vote.
