We all need to understand that this fight we’re engaged in is not just about our individual case, or all the cases we fight for for our clients. The fight we are engaged in is for the very heart and soul of our courts and ultimately our country as a whole.
Dark, shadowy and evil forces have conspired against the American people. They have laid siege to our economy and they have infiltrated one of the last bastions of our freedom and safety–our courtrooms. How else can you explain the sorry state of affairs in courtrooms all across this country where, here in the State of Florida for instance, the Florida Attorney General is investigating the foreclosure mills for engaging in false and deceptive practices while at the same time the Foreclosure Rocket Dockets are churning right ahead, grinding out foreclosures based on questionable documents…like so much rancid meat in a sausage factory?
This week alone, elected circuit court judges and unaccountable retired senior judges will grant millions of dollars in foreclosure judgments based on evidence that is questionable at the very least. Attorneys and pro se defendants will plead for mercy and some semblance of equity and fairness, but their pleas will be crushed under the weight of bulldozing forces that are aligned against them–the courts they pay for, the corrupt lenders and Wall Street Fat Cats and the foreclosure mills that their attorney general is investigating.
Our courts have no idea who these millions of dollars in foreclosure judgments benefit. Who or what is the IXIS trust? Who will Saxon Mortgage Servicing transfer that title to? Why is US Bank the named Plaintiff when Deutsche Bank asserts they own the mortgage? Is it permissible for one of the state’s largest foreclosure mills to attempt to sell its operations to a “blank check company which has its principal business and/or material operations in China”?
In the midst of this battle it’s easy to lose sight of these important questions, but we must all ask these questions every day. It’s not enough to argue your motion and walk out of that courtroom. You must take the time to interject these questions in at every opportunity. Don’t just wander the hallways aimlessly, engage those JA’s in that conversation. Make these questions part of the written record of your hearing. (MAKE SURE EVERY HEARING HAS A COURT REPORTER.) Ask these questions of opposing counsel, many of whom are asking the very same questions of themselves. Seek out press and opinion leaders and engage them in this conversation.
