Sad part is that the judge gave the plaintiff 60 days to correct and refile the pleading. He should have dismissed with prejudice. If the idiot cannot file a proper pleading having done hundreds he shouldn’t be able to re issue. Would the judge give the defendant the same amount of time to correct a pleading upon losing a case? I think not.
If 1.110(b) were enforced regularly it would kill at least 75% of the cases.
