What is Probate?

Probate is the procedure by which wills or other trust documents are filed in court and the assets of someone that has died is transfer to friends or loved ones pursuant to the terms of the trust or the will that’s been deposited with the court.  The probate process occurs in the probate court in the jurisdiction in which the person died or which they have property.  It is important for you to consult with a local attorney that’s familiar with the procedures in the jurisdiction, in which the person died, to make sure that your rights are properly explained to you.

Probate and estate administration process is the procedure by which the court supervises the disposition of someone’s assets after they’ve died.  If the person that died has a home, cars, stock accounts or other assets those need to be brought before the court so that the court can supervise how the assets are transferred to loved ones or friends that may have some interest in a will.
