Foreclosure Defense Florida

The Florida Supreme Court Wants to Hear From You….For What it’s Worth…

Theoretically at least, we still live in a country where citizens can speak out and provide feedback and criticisms of their government.   In a variety of very specific ways, this basic right is being challenged.   Our legislators are grossly out of touch with the voters.   Our courts are grossly underfunded and increasingly unable to protect the rights of the people.   The foreclosure Rocket Docket   is a timely and dramatic conflict with the constitution, which in the State of Florida requires that voter’s disputes be decided by judges that are subject to the will of the people.

The attached notice suggests that the Supreme Court wants input from consumers.   I’m not sure if it matters or what impact your comments might have, but the request is made for input…

Sir, I am in disagreement that the lack of resources for our courts in some way is the cause of the judiciary rendering decisions and foreclosures that are tainted with fraud. I do not see how a judge can ignore the rule of law and with prejudice grant the plaintiff so much liberty and protect them, while denying defendants redress and dismissals. Money has nothing to do with this and ethics has everything to do with it.

I sat in Judge Taylor’s court here in Tampa and listened to her prejudice against lawyers for defendants and it was very clear she favored the lawyer for the plaintiffs. I shook my head. And she calls herself a senior judge?

In seven or more cases I listened to, she was hard on the lawyers for plaintiffs when it came to condo association demand for payments, even sanctioning one plaintiff to pay the attorney fees of the condo association. But in the next five cases of plaintiffs seeking dismissal for lack of standing and capacity, she slapped them all down and in my opinion showed a biased and slanted attitude. I shook my head in disbelief. Court resources had nothing to do with this bias or the rulings.

Defense attorneys go into court with good defenses. But the judges refuse to rule by law. They rule by some secret rule book or some secret instuctions by chief judges. This is judicial fraud as I see it. Why can’t the judges be impartial? Why favor the plaintiffs? Why become robo-judges just to clear their docket? This is not justice. This is a violation of our constitutional rights. But our attorney generals are selling us all out for settlements that do not in any way apply to plaintiffs in foreclosure. They want to use these to help people stay out of foreclosure and use the fraud against those already suffering or who have been defrauded to get that money.

I am sick of it already. This is why many of us will stay in the fight. We will not give up. And we will also vote judges out. That is why these chief judges, to deny us our constitutional rights, are using senior judges who are beyond accountability to the election box. This is legalized rabid tyrrany.

Money will not change the current hate and prejudice of judges in Florida against defendants. And what’s more, when I saw the way the judge treated the defense lawyers, while he sat there give respect to the court like she was some god not to make angry or mad: I got it. Our lawyers are now being mistreated with prejudice and it gave the the feeling if I dared use a lawyer in that court I was damned to failure because defense lawyers were looked upon as shysters representing people wanting a free house.

I departed from the court room and could not even go to the food court for a sandwich. My stomach was in knots. And the other defendants I saw leaving with sad faces I knew already felt the prejudice.

I saw no justice except for the condo association which was not a defendant home owner at all. Strange how one argument worked for the condo association but when raised by the defense lawyers for defendants, they were slapped down.

God, please give us justice or destroy our court system until justice can be restored.

    • I hope that you will share your comments. The Bar and judges are already coming after me for standing up and speaking my mind. They will continue to come after me until they have crushed me. I can only hope that real people will stand up and fight for themselves to stand up for the Constitution. It’s a scary world and I wish I knew why we suffer such bias….

From my experience, judges running illigal our ligal system. Judge Miller in WPB, FL, is the worst thing, that can happened to the judicial system. She is hateful, prejudice and all arond judge, that thinks that she is the law. And I dont see how the money will change that. She is disrespectful to the lawyers, even worst to the defendants. She never willing to lissen to the facts, she is inventing things in her head, and when presented with the facts, gets nesty and ignores them.
I hope one day somebody will try to restore our system and save all that money, that this county is spending on incarsorating people, that should not be there.
