In short: A 1099-C reports debt a lender cancelled. Cancelled debt is generally taxable income unless an exclusion applies, mainly bankruptcy or insolvency. The special exclusion for forgiven mortgage debt on a main home expired for debts discharged after 2025, so foreclosure, short sale, and modification decisions now carry more tax risk. A 1099-C often arrives months after a foreclosure, short sale, settlement, or charged-off credit card. It is a tax form, and it has real consequences.

What the Form Shows

  • Box 2: the amount of debt discharged.
  • Box 4: a description of the debt.
  • Box 6: a code for the "identifiable event" that triggered the form, such as bankruptcy, the expiration of the statute of limitations, an agreement, or the creditor’s decision to stop collecting.
  • Box 7: for foreclosures and similar transfers, the fair market value of the property.

Is It Taxable?

Cancelled debt is generally income (26 U.S.C. § 61(a)(11)). Section 108 excludes it in several situations, most importantly:

  • Debt discharged in a bankruptcy case.
  • Debt discharged while you were insolvent, to the extent of the insolvency. Insolvency means your liabilities exceeded the fair market value of your assets immediately before the discharge.

The exclusion is claimed on IRS Form 982.

The Mortgage Exclusion Is Gone

For years, forgiven debt on a principal residence ("qualified principal residence indebtedness") was excluded. That exclusion covers only debt discharged before January 1, 2026, or under a written arrangement entered into before then. For a foreclosure, deficiency waiver, short sale, or principal reduction now, the tax can be real unless insolvency or bankruptcy applies. Older videos on the channel describe the exclusion as available; it no longer is for new discharges.

Does a 1099-C Mean the Debt Is Gone?

Not necessarily. A 1099-C is a tax reporting form. Courts have disagreed about whether issuing one bars the creditor from collecting. Don’t assume you are free of the debt, and don’t ignore the form either.

Why Old Debts Generate 1099-Cs

Creditors sometimes issue the form years later, when a statute of limitations expires or when they decide to stop collecting. The Box 6 code tells you which.

Foreclosure Decisions and Taxes

Florida is a recourse state: a lender can seek a deficiency after foreclosure. If it waives the deficiency in a deed in lieu, short sale, or settlement, a 1099-C can follow. Insolvency calculations and timing should be part of the decision before you sign.
