For Failure to Disclose Mortgage Modification Agreement

The banks are operating yet another foreclosure scam and this time it’s one that is an attack not just on the integrity of the court system, but theft and an attack on all the citizens of Florida.

The law in Florida is clear. Every time there is a modification of a mortgage and the principal amount increases or the terms change, that is treated the same way as a refinance….and documentary and intangible taxes are due on that transaction before that home can be foreclosed upon.

But in a disturbing number of cases, banks are getting away with not paying those taxes that are due….and in many cases not even disclosing to the court the existence of the modification agreement.

This simply should not be tolerated and we of course make this an issue in every single case….but it goes on far many more times…who knows how many tens of thousands of times across the state…and courts simply are not policing this.

So once again a fleecing of the public purse at the hands of the banks.

In this instance, its very clear we’re all paying the price.

So why won’t courts police and enforce these blatant and systematic violations?
