I really hate this argument…it shows how the court places an unrealistic burden on homeowners…and just lets the bank walk away with very sloppy and inappropriate behavior. A great job by homeowner’s attorney protecting and defending…but the appellate court just lets the bank walk away!
Unfortunately this case resulted in a PCA to bank….a sad commentary on what has become the state of affairs in Florida Courts.
