What If A Plaintiff Wants To Settle A Case, To Not Move Toward Foreclosure But The Court Won’t Allow?

foreclosure-courtAs attorneys, we’re charged with working together to try and resolve matters to the satisfaction of all parties involved….Right?   This is especially true in the case of foreclosure litigation where very specific federal initiatives and programs demand, that’s right DEMAND that plaintiffs work with defendants prior to proceeding with foreclosure.

So if a Plainiff, that’s right a Plaintiff, advised the court that the parties were participating in federal programs that provided real alternatives to foreclosure and asked that the proceedings be stayed, the state court would be compelled, perhaps even obligated to respect the request of the plaintiff and the imperatives of the federal program right?

Well, apparently this isn’t necessarily the case…..
