Today, I filed suit against Kids Wish Network because I believe their practices amount to false, deceptive and unfair practices which abuse consumers and citizens all across this country. Kids Wish Network was identified in a CNN report as “The Worst Charity in America” and which operates from a metal warehouse behind a gas station in Holiday, Florida. The report goes on to assert that Kids Wish spent less than 3 cents on the dollar to actually helping kids. Click on the link to see CNN’s full report below:
As alleged in the lawsuit, using images of people like Barack Obama and Taylor Swift and featuring their images prominently on their website in a way that suggests these individuals support or endorse the fundraising schemes of this organization is just improper. The question that will be presented to jurors here in Pinellas County is:
When you look at this image, do you believe the use of this image is intended to create the impression that Barack Obama approves of Kids Wish Network? And do you believe that Barack Obama wants his image associated with the charity that CNN identified as, “The Worst Charity in America”?
How about the next image. Does Taylor Swift know that her image is prominently featured on the Kids Wish Network website?
The lawsuit I filed is important because it marks the second time I’ve sued under Chapter 496, Florida Statute, Florida’s Solicitations of Contributions Act. The last time I filed suit under this Act, Florida’s Attorney General, Pam Bondi subsequently filed a similar lawsuit to shut the charity down. The greatest honor and privilege about practicing law is being able to take concrete and definitive steps to right very real wrongs that exist in this world. And there is no greater example of this than suing charities that abuse the public trust. This effort represents the beginning of a movement that is brewing and will move across the country. Mark my words: Good people, good attorney generals and legislators are going to take the charge and shut down the abuses of charities that offend the public interest.
These lawsuits I’m filing are a calling and a call to action. Charity scams represent multi million dollar violations of the public trust. They prey upon the most vulnerable members of society…those that are sick and in need. At the same time, charity scams prey upon the very best impulses, intentions and good nature of people…those people that contribute to scam charities don’t recognize that their money is not going to the good charities that actually devote significant portions of charitable money to serving legitimate ends. And finally, these scam charities prey upon the good nature of celebrities and organizations who are willing to contribute their time, treasure and talent to help those in need.
