Listen as the Florida Supreme Court considers whether lenders must pursue foreclosure cases no later than five years from the date of acceleration. My analysis is the best we can hope for is a finding that the note is not enforceable but that the principal amount of the mortgage remains enforceable…and that the mortgage can be sued upon as a violation of those independent mortgage obligations.
