Florida House Set to Consider Non-Judicial Foreclosure Bill on Monday, April 12!

Florida Attorneys who are Fighting for Homeowner’s Rights Will Rally on Tallahassee, Wednesday, April 21, 2010, by the Florida Bankers are trying to beat us to the punch by pushing their anti-consumer legislation through before we can get up there to stop it.

On Monday, April 12, 2010, the Florida House of Representatives, Criminal & Civil Justice Policy Council will meet beginning at 1:00 p.m.

One of the bills that will be discussed in this meeting is House Bill 1523, absurdly titled, the Homeowner Relief & Housing Recovery Act.

It just offends me how they think they can paint a pig and try to make it a rose. It offends me that bankers can convince our elected leaders to use such blatantly misleading titles to legislation in a concerted effort to fool consumers.

This bill represents a concerted effort by Florida Bankers and other anti-consumer groups to strip citizens of their right to have foreclosure cases heard by judges.

Please click on this link and contact each of the legislators who sit on this committee.   Call, email, fax and tell them you are OPPOSED TO ALL EFFORTS TO TURN FLORIDA INTO A NON-JUDICIAL FORECLOSURE STATE.

Tell them you’re sick and tired of the fraud and deceit used by bankers and their friends on Wall Street and remind them that they work for you, The People of the State of Florida!

  • I’m no expert in the legislative process, but I think that this Florida House Bill HB 1523 is up for a a committee vote (as opposed to a Floor Vote) on Monday, April 12, 2010. I’m trying to educate myself on the details of this process. It appears that this bill is to go in front of three committees, the third one is scheduled for the Monday Vote.

    Then, it will go to the full House Floor for a consensus vote. Since two committees out of three have already passed this bill, I’m not sure of the point of having the third committee review and vote on it.

    We have to find out when this bill will be referred to the full House Floor and if comments and testimony will be accepted. Also, the state Senate hasn’t begun the process, or the plan is to just approve the HB1523 in the Senate without a new bill that needs to work it’s way through the system.

    This bill had this horrible new language in the beginning when it was filed on March 1, 2009.

    It was edited to lessen it’s power, scope, and effect on March 23, 2010.

    It was ramped back up, by a multi-fold bait and switch technique on March 30, 2010.

    Then, either a similar bill has to pass in the state Senate (companion bill SB 2270 has not yet been introduced) OR the House Bill HB 1523 will travel to the House Senate for a vote.

    If both the state House and Senate pass the bill, then the governor must sign it before it gets passed into law.

  • I am sickened by this piece of legislation. Physically sickened! After sending emails on Friday and making phone calls that I felt were falling on dead ears, I have been brought to tears. I have been working as an activist for foreclosure victims for about three years now and I feel like I am watching the people being robbed and beaten and I am bound and can do nothing but stand by and watch and do nothing about it. Even the title of this piece of work is misleading.

    thank you for alerting us to the black hat methods being used.
    Please tell us… WHAT can we do.. when they are passing these bills without the majority of Americans even knowing that these bills are pending?
    I want to run for representative, and I am not sure that I will even get the support that I need because most people are not aware of what is happening in our state, they will think I am a fanatic…
