I have observed that the more wrong a foreclosure proceeding is, the more the servicer digs in to “beat” the homeowner. This may have to do with liability it could face for servicing violations. Fair Debt Collection Practices Act violations, with the award of reasonable attorney’s fees to the prevailing borrower, could reverse the incentive to try to cover up servicing violations by aggressive litigation on the part of lender’s counsel.
