I have seen a great deal lately regarding scams, fraud and overall misrepresentation of the facts related to Foreclosure. I am not interested in those who knowingly entered into an agreement to purchase a house that they cannot afford and now cry because the Bank wants the money. I am discussed with attorneys who will lie, cheat and go against the legal system rules to push the foreclosure through at a fast pace.
This action has now clogged the court systems and cost untold amounts of money. In short “The Law Is the Law “. If you are going to represent the banks, “FOLLOW THE LAW”. If you are going to defend a person who is in foreclosure “FOLLOW THE LAW”. I am glad to see that the corruption that has been going on for a while is now being looked into. One area that I specialize in is the investigation and preparation of the Affidavit of Diligence. Being used to move cases forward with when the defendants cannot be properly served. Most people do not understand that if you hide your head in the sand and hide from the service it just prolongs the process, but it does not go away. An investigation is done to try and find the defendants. If they still can’t be found, the Affidavit of Diligence related to the search is filed with the court and the action moves forward.
Now comes the fun. I have reviewed thousands of Diligent Affidavits and the majority of them were not worth the paper written on. Either the person preparing the Affidavit was not qualified to do so or they had no idea of how to find someone. In addition, they had no knowledge or understanding of Investigative data available and failed to properly read what they received. Why more challenges related to the Diligence affidavit are not filed is a mystery to me. Prior to the Supreme Court coming out with specific guidelines on the Affidavit of Diligence most investigations were done using the rules of the Family Law Diligent Report. Now that I have reviewed the “New & Improved” report from the court I found two things. It was prepared without asking anyone who finds people for a living, and it was prepared by Lawyers who are interested in going through the motions of finding someone and not actually finding them.
I would tell any and all persons who were not personally served with all paperwork related to your foreclosure to get a copy of the diligence report and read it. Those attorneys who represent the people in this fight do the same. If you do not understand it, Find a professional who does and have them break it down for them. You have no idea what information can be disputed in this document. How they found the information, where they found the information and what information they searched is critical and easily falsified in this document.
What you speak about is very important. However, I never hear anyone speak about this. How these banks ruin customers who are paying on time but have reduced income. They go to their bank and the bank says apply for a modification but you have to be behind on your payments to qualify so stop paying and submit an application.
The first thing the bank does is ruin the customers credit, then most of the time, they deny the modification. Now the customer is 3-5 payments behind because the bank told them not to pay until they are given a trial payment and after they deny the modification they also want to be paid the difference between the trial payment and the regular payment. Then when the customer can’t make up the missed payments the bank said not to pay, the customer’s credit is ruined so they can’t get financing anywhere else and the bank starts a foreclosure proceeding.
Banks seek modifications not to grant them but to show the Feds that they are trying. Fraud in the foreclosure process is one thing, but purposely and maliciously ruining people so they can satisfy federal requirements is another.
People need to educated to the fact that the Banks lie and cheat and that they have to memorialize how the Banks go about ruining them in writing. Defense to these improper foreclsoures have to be orchestrated.
