All Bank “Property Preservation” is Unlicensed Contracting, It’s Time For Our State To Act!
I have had it with the banks hiring jack booted thugs to kick down doors, change locks and remove personal property.This is a dangerous violation of fundamental rights that must not be allowed to continue.
I am disappointed that law enforcement across this state has bought into the lies and campaign of misinformation conducted by the banks and their shady network of subcontractors. The law is clear, the banks do not have the right to enter any home until they have a lawful order signed by a judge.
An American’s home is his castle and it must not be subject to search or entry without a lawful order of a court
and executed with law enforcement present.
Law enforcement agencies all across this state are being inundated with calls from consumers complaining of unauthorized break ins by the banks, but they take the side of the banks and their thugs. Most recently read the following report issued by the Hernando County Sheriff’s Office about an incident that happened to Chris Boudreau. Now, Boudreau disputes much of what is contained within this report, and there are many other more damming facts that are not included. The point to be made here is the guy’s home was forcibly broken into, his stuff was stolen and law enforcement will not protect him.
Unfortunately, law enforcement in this country will not begin to act until someone is killed or seriously hurt when one of these incidents occur.
Until they do wake up and start defending the homes of the people they have sworn an oath to protect, it’s time to pursue another avenue that will provide some means of protection, Florida’s Unlicensed Contracting Law:
“Contractor” means the person who…for compensation, undertakes to, submits a bid to, or does himself or herself or by others construct, repair, alter, remodel, add to, demolish, subtract from, or improve any building or structure, including related improvements to real estate, for others or for resale to others; and whose job scope is substantially similar to the job scope described in one of the subsequent paragraphs of this subsection.
“Contracting” means engaging in business as a contractor and includes, but is not limited to, performance of any of the acts as set forth in subsection (3) which define types of contractors. The attempted sale of contracting services and the negotiation or bid for a contract on these services also constitutes contracting. If the services offered require licensure or agent qualification, the offering, negotiation for a bid, or attempted sale of these services requires the corresponding licensure.
So What’s the Penalty?
(2)(a) Any unlicensed person who violates any of the provisions of subsection (1) commits a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083.
Today’s Jack Booted Thug OUTRAGE! The Banks As Burglars and How Do We Stop Them?
Forget all the other questions and controversy surrounding fraudclosuregate. Forget the forged or fraudulent or sloppy assignments. Forget standing and trusts and pooling and servicing agreements. Forget possession of the original note. Forget the “technical” areas of the law and court process. Let me ask you one question:
SHOULD AMERICANS HAVE THE RIGHT TO BE SECURE IN THEIR HOME FROM UNREASONABLE
SEARCHES AND SEIZURES?
Now just a few short months ago, I thought the answer to that question was, “Duh, Yes Of Course Americans Have The Right To Be Safe In Their Homes From Unreasonable Searches and Seizures”. If I was feeling really academic I might belt out a little Constitutional Law and sing out…..
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and ht no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
(THE FOURTH AMENDMENT TO THE UNITED STATES CONSTITUTION)
But I would be WRONG AGAIN WEIDNER! You see, Americans do not have the right to be safe and secure in their homes…AMERICANS DO NOT HAVE THE RIGHT TO BE SECURE IN THEIR PERSONS, HOUSES, PAPERS AND EFFECTS….because at any moment, the banks can come and kick down your door. If they like, they can change your locks. And if you’ve got papers and valuables lying around, they may just help themselves to them.
And don’t think you can convince law enforcement to protect you….law enforcement will leave you alone. Helpless. Defenseless. While the Jack Booted Thugs Come Back Again and Again and Again. Which is exactly what my client William Coyle claims happened to him:
Bill Coyle is on the verge of losing his home of 17 years to foreclosure, and that’s not the worst part.
The Lutz man claims between $200-300 hundred thousand dollars worth of automotive parts, tools, and equipment stored in his garage from his defunct Corvair restoration business have been removed from the now-vacant Vandervort Road home by an unidentified company working for his lender.
The catch is while Coyle’s house in foreclosure, the court has not yet ruled on his lender’s (GMAC) request to take possession of the home. “I screamed bloody blue murder but it didn’t do any good,” Coyle tells the I-Team.
JACK BOOTED THUGS- THIS WEEKS TRASH OUT STORY….AND NO ONE CARES
Another week, another American Home Invasion that is ignored by the police and disregarded by the arrogant banks that are empowered and intoxicated by unchecked power.
To all of you who think……this is an outgage and he should sue and he’s gonna get a payday and what these banks did is so wrong. Let me just tell you that I am litigating these cases hard and you are sadly mistaken if you think the law or law enforcement will protect.
You would be absolutely dumbfounded if you knew the details on just how hard it is for people who are the victims of these most egregious crimes to get even the first dollar of compensation. Read on in disgust….and keep in mind this guy will litigate for years and if he’s lucky he may get a few sheckles from the wrong doers….
Brooksville, Florida — Imagine coming back to your home after being away a few weeks and finding the locks changed and the home trashed. That’s what happened to Chris Boudreau of Brooksville.
Boudreau showed us the home, which was stripped bare.
BREAKING AND ENTERING IS NOT A CRIME!
Not so long ago in this country breaking into another person’s home would clearly have been a crime.
When law enforcement cared. When those we elected to protect us cared. When Judges cared.
But that was long ago. Before the banks, foreclosure mills and Wall Street criminals took over this country and trampled on the rights of any soul who dared cross them or get in their way. Today we live in a much different world. The banks and their agents are emboldened. They fear no government official. They fear no judge. They are restrained by no law.
I have begun collecting terrifying examples of bank terror and will continue to publish the examples. For starters, I want each of you to read the lawsuit I’ve just filed. Read carefully the allegations made in the lawsuit, but most importantly read the report from the Charlotte County Sheriff’s Department. Read the findings of fact. Two thugs broke into a home, moved property around, helped themselves to a beer. The thugs returned and boldly told their victims they would return to terrorize again. Two visitors to our country were terrified. Thousands of dollars in property was stolen. But the Sheriff’s office can seem to find a crime here.
The thing that terrifies me most about the incidents described in this lawsuit is the fact that I have logged dozens of phone calls to various levels of authority within the Charlotte County Sheriff’s Office. I have spoken with street officers, detectives, supervisors, even internal affairs. My calls have been ignored. I’m not sure if I’ve gotten high enough up the chain of command, but I’m going to keep working, keep calling and keep filing lawsuits until this issue gets the attention that it deserves.
Pay attention to the facts in this case and be appalled, but sit tight and stay tuned because as bad as the facts in this case are, I’ve got worse cases and am preparing to file additional cases with even more grotesque facts. If law enforcement, particularly our elected Sheriff will no longer protect us in our homes, who can we count on to protect our families? When one of these lender break ins results in physical harm either in Charlotte County or in some other county across this country, law enforcement cannot stand by and say they were unaware of this phenomena.
Please share your examples with me. We cannot stand by and allow these fundamental violations of rights to occur. I hope that press picks up on these stories and that our elected officials and judges will wake up serve those they took an oath to protect.
