We all know Florida is developing some….ahhh, interesting “legal” theories.  One notable new legal concept from the Sunshine State is called,

“there’s no such thing as forgery, we call it “surrogate signing” down here”

(except that wait a minute isn’t that what AHMSI is suing LPS for?)

and then there’s this other one called,

“there’s no such thing as notary fraud down here we call it, “not illegal to violate the express terms of Florida’s Notary Law”

and then one of my favorites:

“banks can kick down doors whenever they damn well please, don’t worry with any court case, much less an Order”

If it all sounds rather scary and lawless and anarchy-like, well, you’re right.  It is indeed quite terrifying to live in a state where blatant White Collar Criminal Lawlessness has replaced hundreds of years worth of a state’s developed body of statutory and case law.  Where citizens and consumers lie helpless in the face of corporations and an entire system of government that is turned squarely against them, bought off and corrupted as it is by campaign cash.

Yes sir, if you want to see the very worst form of White Collar Criminal Oligarchy that bankster money can buy, well just turn your gaze down here to Florida and you’ll find a perfect case study….everywhere you turn.  And the world is indeed watching.  There are still a few people who give a damn.  A few strong and brave voices who dare to stand up and point out the insanity and danger in all of this.

I find it most regrettable and frankly terrifying that we live in a state where such lawlessness is the accepted state of affairs. I hope that our northern brothers and sisters, all fellow Americans, will not abandon all the good people who live down here and who suffer under this tyranny….take note of what some quite esteemed and authoritative sources say about the state of affairs:

Wow. So LPS used the whitewash IG report from Florida to justify the dismissal of their lawsuit in Nevada. And remember, LPS lobbyists more recently urged the Florida AG’s office to intervene on their behalf in a criminal case in Michigan. The connections between the FLorida AG’s office and LPS just continue to grow.

This also happens to be BS.

A potent mix of frustration and anger is brewing once again in this country because the well-heeled monied interests, Fat Cat Bankers and Shyster Attorneys have once again gotten caught sticking it to normal Americans. Ignoring the rules with an arrogance that would be astonishing if we all were not so used to it by now.

In the midst of this brewing storm and calls from Congress and Attorneys General from several states, Florida’s top court, the Florida Supreme Court punched the whistle blowers straight in the face with a staff-level letter that essentially said,

“GO MIND YOUR OWN BUSINESS CONGRESSMAN, WE DON’T CARE ABOUT YOUR CONCERNS. CALL THE FLORIDA BAR, MAYBE THEY’LL CARE!”

(Not a peep out of the Florida Bar….yet. [Ever?])

Well now in an incredibly ironic turn of events, just days after the blow off letter was issued, the perpetrators of the fraud the Congressman complained of have been forced to acknowledge their misdeeds.  Trial court judges can ignore the problems, even the Supreme Court can ignore the problems, but the title insurance companies that are holding the bag for all of this have essentially confirmed what Congressman Grayson and Attorneys General from several states are complaining about.

The title industry is reeling, real estate is collapsing and there is a profound and pervasive crisis in confidence that has swept across this country because our courts have lost the respect they would have been entitled to had they taken an authoritative role in this crisis.  Instead, our courts (Trial, Appellate, Supreme) they’ve abdicated their responsibilities and turned the keys to the courthouses over to the Wall Street Fraudsters and their attorneys.  You see this everyday in the reckless, unfair and prejudiced Rocket Docket proceedings which are effectively run by the foreclosure mills, for the foreclosure mills.  Their attorneys don’t even bother to show up to hearings. Sometimes they call in by phone.  Sometimes, judges just enter Summary Judgments even when no one is there in person or on the phone.

Just think about this nugget.  I’ve been going to Summary Judgment Hearings for years now.  I’ve seen thousands of Summary Judgment hearings in courtrooms all across this state.  I cannot remember but a handful of cases where there was an attorney present for one of the foreclosure mills that actually had a copy of the case file with them.  That’s right.  They show up to court with nothing.  No file, no documents, no evidence.  At best they’ve got a spreadsheet, a print out from a computer.  And yet they stand there or call in demanding that the judges sign Orders throwing people into the streets.

THE REAL SCANDAL HERE IS THAT OUR JUDGES SIGN THOSE ORDERS…HUNDREDS OF THOUSANDS OF THEM

I want our press to see this and record this and broadcast this.  I want to see video cameras in these foreclosure rocket dockets. Shine the light on the empty-handed foreclosure mill attorneys or the no-show attorneys or the telephone attorneys. (How do we even know who’s on the phone?)

Let’s hope the press keeps up the heat on this, but no one will be able to put the lid on the bubbling cauldron of fraud, lies and deceit that are found in foreclosure courtrooms across this country anymore.

A few days ago I asked for examples of questionable affidavits and assignments.    Attorneys and activists are often screaming about notary and filing fraud, but quantifying the fraud and presenting it is very difficult.

Attached here is an amazing powerpoint presentation that asks some important questions about affidavits and assignments that are of record across the country.  Now I was only able to attach abou2 20 pages here, but the presentation is more than 161 pages long.  I will be posting more of the slides later, but I encourage everyone to take a close look at the presentation.  It should provoke some important questions for every party involved in foreclosure in any way.

The most important question I ask is how our courts are continuing to allow such improper filing and recording activities to continue?  Keep in mind that all that is required in the vast majority of cases for a foreclosure to proceed is an assignment of mortgage and an affidavit of amounts due and owing….as you will see from the slides on the presentation, these documents are easily (and often are) created in a questionable manner.
