Indymac Federal Lawsuit- Feds Sue Former Indymac Directors

indymac-foreclosure-fraudThe attached lawsuit provides important and valuable information about Indymac generally that can be useful in every Indymac case.  Now I didn’t read the entire 317 page lawsuit, but I poured through the first hundred or so pages.  It provides very detailed insight into the corporate culture that led to the collapse of Indymac.

Remember as you are engaged in foreclosure litigation on behalf of homeowners that the federal government, through the FDIC, concocted a sweetheart deal where yet another group of fat cat Wall Street types will undoubtedly make obscene profits while you and I (and the homeowner being sued for foreclosure) will absorb all the risk and loss.  It is with this in mind that Indymac/Onewest homeowner foreclosure cases sting me so badly.  In my equitable world, if you’ve got an Indymac foreclosure they would be forced to accept a most generous modification or short sale in order to set off the phenomenal deal that’s already been done…..but then that’s the fantasy world I live in…..

INDYMAC IS A FAILED CORPORATION- THEY SHOULD NOT BE ALLOWED TO CONTINUE IN LITIGATION!

Keep up the good and honorable fight to protect homeowners like my 84 year old homeowner, Erice Davis.  Fight the arrogant and out of control banks who continue to kick the weakest among us when they’re already down.

Fight to understand who really benefits if an elected circuit court judge throws their neighbor out on the streets. (Fat Cat Wall Street Bankers and foreign investors like Deutsche Bank)

Fight to uncover, expose and disclose who the real owners and beneficiaries of foreclosure litigation are…don’t let them hide behind servicers or straw-man litigants….make them come forward and fully disclose their claims.

Force litigants in foreclosure litigation to come to the settlement or mediation table prepared to accept real world, practical settlements rather than pre-programmed loss guidelines that are subsidized by our tax dollars. Indymac Bank Fraud- Deposition of Employee That Proves It All!

If you’re facing foreclosure, or are interested in mortgage modification, deed in lieu or short sale issues related to property, especially in Florida, you should be aware of massive, wide scale fraud that permeates the entire mortgage industry.  As the mortgage market exploded and lenders across the country were tripping over one another in a mad orgy to make mortgages, agents and employees of the lenders committed fraud from the begining of the process selling the loan to the homeowner all the way through to the packaging and selling the fradulent loans to end investors.

Lost Notes, False Affidavits of Amounts Due and Owing, Fraudulent Assignments of Mortgage

Now lenders trying to foreclose on these fradulent mortgages must continue the lying process in order to try and collect on the fradulent mortgages.  The lies come in all shapes and sizes from itty bitty lies (I’m a vice president of Indymac Bank and we’re owed $100,000) to big fat whopper lies (I’m an officer of Indymac Bank and I’ve assigned the mortgage to US Bank.)  The attached deposition transcript of Erica A. Johnson Seck illustrates precisely how the fraud occurs and shows how the fraud is ongoing.  If the same questions were asked in every foreclosure case, the same facts would show up in a large majority of foreclosure cases that are currently pending in courts across the state….the person that has signed documents that form the case against the homeowner has absolutely no basis to make the statements or sign the affidavit.  The end result should be a dismissal of all foreclosure cases where these facts are proven.
