It has been more than one year and still no one. no one. no one. has dared to turn this rock over and consider what it means. I’ve just sat on my hands with this one. I’ve been waiting, hoping, praying that someone would dig into this. Some bright and ambitious reporter. Some elected leader with some sense of perspective. Anyone. But no. Here we are more than a year and not a single drop of ink. Not a single pixel on a blog or online story anywhere.

Sure, the rich and powerful have rules. They’re just different than the rules that you and I live by. The entire foreclosuregate fiasco is a dramatic, long running, slow speed train wreck continuing example of this. I’m past the point of outrage over the whole thing.
The most current example of the phenomena that the rich get to play by different rules involves the recent announcement by David Stern that he was walking away from his law practice…and hundreds of thousands of cases left pending in courtrooms all across this state.
THIS IS COSTING TAXPAYERS MILLIONS OF DOLLARS AND CREATING DESTABILIZING CHAOS IN OUR COURTROOMS– WHERE IS THE OUTRAGE?
While you’re pondering those questions keep in mind that Stern processed hundreds of thousands of foreclosure cases over the years and amassed millions of dollars in wealth and assets. How you doing out there people? Planning to sail away on your multi million dollar yacht today? Cozy and warm in one of your multi-million dollar homes? Driving around town in one of your cars worth hundreds of thousands of dollars? Picking your kids up from private schools that cost tens of thousands of dollars?
Oh No, that’s right. You’re not one of “them”. The crowd that’s sucked and bled dry every one of us…..
At least our press cares enough to continue reporting on this exhausting issue….

Stern is emblematic of everything that’s ugly and wrong with the mortgage banking and finance industries in this country. Whether all the allegations about him are true is irrelevant. In my view, he’s an unethical, arrogant, abusive and callous piece of itinerant garbage who obviously cares nothing about who he harms as he pursues his sole objective of putting people out of their homes as quickly as possible… the sort of person that I personally might gladly go pay-per-view to watch get hit by a fast moving city bus.
Stern’s firm has been accused of gouging homeowners trying to get out of default, as exemplified by the 1998 class action lawsuit filed by Tallahassee attorney, Claude Walker on behalf of tens of thousands of homeowners alleging that Stern piled on excessive fees when they were trying to keep their homes. Stern settled the case for $2.2 million after a couple of years, and both the Florida Supreme Court and Florida State Bar Association reprimanded him for “professional misconduct,” related to the case.

The collapse of the Law Offices of David J. Stern is causing chaos and costing taxpayers millions of dollars. Clerks of Court, judicial assistants and judges across this state are left sorting through files and processing Stipulation to Withdraw paperwork and generally left to try and sort out the mess. That costs every single taxpayer money. Multiply that by hundreds of thousands of files in counties all across the state and you’re talking a massive burden on this state’s taxpayers. Meanwhile, the clients, including Fannie and Freddie, must now go through each of their files to assess just what kind of a mess they have on their hands. The resulting time and attorneys fees will add many months and millions of dollars into the mess.
When the general public and taxpayers are paying for all of this, I have a real problem when the Fat Cats that caused all of this are not forced to pay the costs….where is any justice, any equality, any fundamental fairness in all of this? Where are all the managers and lawyers and bright financial people that put all of this together? I bet they’re still driving their obscenely expensive cars, living in obscene castles, with obscene boats.
How do our government leaders allow this to continue? Why no handcuffs? When will Florida’s Attorney General step up, speak out and release findings from the on-going investigation? Many mechanism exist to try and reclaim some of the costs, but the most black and white immediate way is to dismiss all pending David J. Stern cases which are not verified and force them to be refiled under the rules mandated by the Florida Supreme Court to protect all consumers.
HOW CAN OUR COUNTRY EVERY REGAIN OUR PROWESS IF WE HAVE LOST THE WILL TO METE OUT JUSTICE?
Transcript of AG investigation- Our New AG Will Pursue Even More Aggressively.

Now that Florida has a new Attorney General, the question everyone is asking is just how aggressively will she pursue the investigation? I believe she will move even more aggressively than former Attorney General Bill McCollum…I don’t believe she has any choice but to move even more aggressively.
In support of this argument, I invite you all to consider all that we’ve learned just since the investigations were announced just a few short months ago. Think of all the details that have emerged in the national and even international press. Consider the details contained within the deposition transcripts….There really is no turning back.
Attached below is a transcript from a hearing that was recently held in Broward County. Stern’s defenders were arguing (presumably with a straight face) that the Florida Attorney General did not have the authority of jurisdiction to investigate the law firm. The AG’s attorneys and investigators responded by providing details of the hundreds of complaints investigators had been receiving from all across the state.
Read the transcript carefully and consider the case the Florida Attorney General has already built against these firms.
BOMBSHELL- Potentially Tragic Consequences

The bombshells are going to start falling like infantry fire on a battlefield….there are consequences for lies and fraud and open deceit….
Judges can either ignore the blatant lies, fraud and deceit or they can enter the Orders just like this one. If they enter Orders like this it will be a sign to the American people that there is some fairness and equity left in this country. All it takes is a few mortgages being wiped out as a penalty for fraud and deceit before the world will really, really take notice of the battle we’ve all been fighting for so many years.
This is not just about fighting for individual homes in foreclosure, it’s about fighting for the heart and soul of America. There must be some victory for the Common Man and Orders like this are it….
