HURRAAH! FORECLOSURE FILINGS WAY, WAY DOWN! PROBLEM SOLVED, MISSION ACCOMPLISHED!

Foreclosure filings have plunged all across the state and it’s like that funny guy George Bush when he landed on the deck and proclaimed:
MISSION ACCOMPLISHED!
From the Bradenton Herald:
The drops were significant: 55 percent in Manatee County, 62 percent in Florida and 27 percent nationally from a year ago, the foreclosure tracking service said.
Experts were unimpressed with the numbers, saying they mask an overburdened court system that’s being pushed closer to gridlock.
“It’s illusionary, said Matt Weidner, a foreclosure defense attorney in St. Petersburg. “The fundamental problems are still there and they’re not being addressed.”

Actually, no one is stupid enough to think the decline in filings means anything good. The decline in filings is actually a clear indication of chaos and catastrophe. The banks didn’t just stop because they’re working in good faith to try and solve their problems or work out solutions. They stopped filing because the whole entire process is permeated with fraud and totally improper legal practice.
The new law firms that have picked up the David J. Stern garbage have no idea how to proceed with many cases. And many cases all across the state are being dismissed, both because the courts are moving them forward and dismissing them and because the Plaintiffs are recognizing they have an obligation to dismiss cases that are infected with fraud.
Given what the declines in filings say about the whole process, what does this say about cases that are still pending? Or about all those cases for which judgment has been granted during these darkest days of our country’s judicial system. Will there be a truth commission at some point in time when we will all examine the hundreds of thousands of files that are permeated by fraud and crimes and a total failure of compliance with our rules of civil procedure? Perhaps law students will use this period in lessons at some point in time….until then we’re stuck here in this legal purgatory….

Attorney David J. Stern has spent much of the past year in the spotlight, as reports of legal troubles plaguing Florida’s home foreclosure system continue to emerge.
Stern’s Plantation-based foreclosure practice is one of eight under investigation by the Florida attorney general for allegations of fabricating documents, slipshod paperwork and questionable fees.
The mortgage lenders who once loved him have severed their business ties with him. DJSP Enterprises, a company he created to handle nonlegal foreclosure work, has been sued by former employees who claim the company violated layoff notification laws as it slashed its staff to about 50. Last week, Stern announced that he will cease the law firm’s home repossession operations March 31.

The foreclosure mills have gutted our court systems and are costing taxpayers millions of dollars…and none has cost you and I more money than David J. Stern from South Florida. Where are any state or federal or Bar officials? Why is nothing being done to seize assets to help pay the public back for all this loss? It’s just a disgusting tragedy that will apparently keep costing all of us major money…..and now from the Sun Sentinel:
Two announcements last week appear to have doomed Plantation foreclosure attorney David J. Stern’s ambitions to become a national player in the repossession of homes lost by Americans during the economic downturn.
It was only a little over a year ago that Stern jumped at the opportunity to push his business and wealth to a whole new level. The underlying plan was to take the legal and financial model that had made Stern rich and successful, and reproduce it in other states.
In January 2010, the Plantation-based lawyer consummated a deal under which he took a key piece of his law firm’s operations public, with Wall Street backers agreeing to buy him out for a staggering $145 million, plus reams of stock in the newly minted corporation.
The last hopes for that grand venture appear to have vanished.

Sure, the rich and powerful have rules. They’re just different than the rules that you and I live by. The entire foreclosuregate fiasco is a dramatic, long running, slow speed train wreck continuing example of this. I’m past the point of outrage over the whole thing.
The most current example of the phenomena that the rich get to play by different rules involves the recent announcement by David Stern that he was walking away from his law practice…and hundreds of thousands of cases left pending in courtrooms all across this state.
THIS IS COSTING TAXPAYERS MILLIONS OF DOLLARS AND CREATING DESTABILIZING CHAOS IN OUR COURTROOMS– WHERE IS THE OUTRAGE?
While you’re pondering those questions keep in mind that Stern processed hundreds of thousands of foreclosure cases over the years and amassed millions of dollars in wealth and assets. How you doing out there people? Planning to sail away on your multi million dollar yacht today? Cozy and warm in one of your multi-million dollar homes? Driving around town in one of your cars worth hundreds of thousands of dollars? Picking your kids up from private schools that cost tens of thousands of dollars?
Oh No, that’s right. You’re not one of “them”. The crowd that’s sucked and bled dry every one of us…..
At least our press cares enough to continue reporting on this exhausting issue….

Stern is emblematic of everything that’s ugly and wrong with the mortgage banking and finance industries in this country. Whether all the allegations about him are true is irrelevant. In my view, he’s an unethical, arrogant, abusive and callous piece of itinerant garbage who obviously cares nothing about who he harms as he pursues his sole objective of putting people out of their homes as quickly as possible… the sort of person that I personally might gladly go pay-per-view to watch get hit by a fast moving city bus.
Stern’s firm has been accused of gouging homeowners trying to get out of default, as exemplified by the 1998 class action lawsuit filed by Tallahassee attorney, Claude Walker on behalf of tens of thousands of homeowners alleging that Stern piled on excessive fees when they were trying to keep their homes. Stern settled the case for $2.2 million after a couple of years, and both the Florida Supreme Court and Florida State Bar Association reprimanded him for “professional misconduct,” related to the case.
