Attorney Abandons Hundreds of Thousands of Cases Harming Clients And Costing Taxpayers Millions
The news is reporting that a Florida attorney just walked away from hundreds of thousands of cases that are pending in Florida courts. This action places hundreds of thousands of defendants in legal jeopardy and will cost our court system millions of dollars in additional work hours that are directly related to protecting the interests of all who are impacted.
Fanne/Freddie, who paid for most of this (with my money) and who should have been supervising, did nothing.
What’s most maddening about this is it happened back in April 2011, we’re all still paying the price for this and no one, no one has done anything at all the parties who are responsible for this…
Nothing from the feds (remember Fannie/Freddie paid millions in advance attorney’s fees and knew long ago about these problems.)
Nothing from the Florida Attorney General (what exactly is happening with all the investigations?)
Nothing at all from any of the many groups or agencies that could do something about this train wreck.
From Today’s Palm Beach Post:
A report issued Friday by the Federal Housing Finance Agency Office of Inspector General said an outside law firm Fannie Mae hired to investigate allegations of wrongdoing confirmed “unlawful” practices and stated that foreclosure attorneys were sacrificing accuracy for speed by filing false documents.
After learning of the attorney misconduct in 2006, Fannie Mae failed to make any improvements in its oversight of the firms.

“The judges are the gatekeepers to jurisprudence, to the Florida Constitution, to access to the courts and to due process,” said attorney Chip Parker, a Jacksonville foreclosure defense attorney who was recently investigated by the Florida Bar for his critical comments about so-called “rocket dockets” during an interview with CNN. “It’s discouraging when it appears as if there is an exception being made for foreclosure cases.”

A few years ago a handful of attorneys, along with a vocal group of consumer advocates, got together and contributed their time, their talent and their passion to make sure Floridians were not victimized by the banksters and their efforts to turn Florida into a non-judicial foreclosure state. Tomorrow, I will post some more details of that effort. Tonight, it should be noted that one of the very first attorneys to stand up and say he was willing to fight for Floridians was Chip Parker from Jacksonville.
Like the other good attorneys involved, Chip stepped up, took on the burden and said to the citizens of the State of Florida….

Since that time, Chip has suffered some of the same attacks and pressure that many of the other great consumer fighters have suffered. Forget what you think you know about American justice, when you’re fighting for the common man, when you’re fighting for the rights of the little guy, you’ve got a Bull’s Eye, painted squarely on your chest….The Dark Side will stop at nothing to take you out.
But Chip is committed to the fight for consumers and, true to form, the moment he heard that the banksters were at it again with their (un)Fair Foreclosure Act of 2012, he came out swinging. I don’t suspect the proud warrior lawyers who dare to stand up to the machine will be permitted to stand forever. Eventually, they will silence us all and hack us all down to size…..but until they do, just listen to what the truth of your world sounds like:
Florida has a proud history of whoring for the mortgage industry, and while states across the country are fighting to restore honor and integrity to our judicial system, Florida has taken a different approach. In Florida, the Supreme Court and our elected state officials are doing what they can to ensure their benefactors . . . the banks . . . get what they want.
Remember Foreclosure Court? It unconstitutionally employed retired senior judges to act as mortgage mercenaries – ramrodding defective foreclosures through the judicial system despite national ridicule. I am actually shocked it fell victim to Governor Scott’s massive spending cuts. That must have been a mistake.
A Brave And Thoughtful Response – Chip Parker Stands Up to Foreclosure Tyranny
I first met Chip Parker long ago when he stepped up and contributed his time and donated money to help consumers across the state of Florida battle the complete take over of our courts when the bankers tried to ram through their Non Judicial Foreclosure Bill. Thanks in part to his efforts, the rights of Floridians to have their foreclosure case heard by an impartial judge was at least theoretically protected.
I say theoretically protected because the general consensus from attorneys around the state is that foreclosure court is a justice system stacked against the homeowner. I recognize the struggle of our courts but I reject the notion that they can simply stand aside and let our judicial system become so corrupted and abused by powerful, arrogant and unrepentant banks and their complicit foreclosure mill law firms.
I applaud Chip for sticking his head up here with this very public criticism of our justice system gone mad. I hope the Florida Bar and our judges know and appreciate the honorable and ethical fight foreclosure warriors like Parker are in–I know that members of the general public do….those members of the general public whose interests are served when good lawyers like Chip stand up and fight not just for his clients, but for every single citizen in the State of Florida…and fact every single citizen in the United States. The fact of the matter is that the issues exposed in this foreclosure war impact every person in this country.
You retirees who think your retirement dollars are safe and sound…..think again. You 4o1k’ers that think your money is there….WAKE UP! Given the scale of fraud and complete breakdown of regulation in the mortgage and foreclosure markets how in God’s name can you possibly believe anything coming out of Wall Street is true? It’s not…..and if they could pull it off with publicly recorded mortgages and (mostly) open courtrooms that are (theoretically) supervised by judges, just what do you think the Wall Street Wizards have already gotten way with in your private investment accounts?
The fact of the matter is it’s too late to stop all of this. Too many people looked away and refused to speak up for too long. Even today, hundreds of thousands of homeowners have just laid down and refused to utter even a whimper of protest. Our jobs are gone…sold overseas. Our technology is gone…sold overseas. Our dollars are gone….sold overseas. Our Congress is still there, but it too was sold out long ago…to the banks that are RECORDING OBSCENE PROFITS YET AGAIN. I’m disappointed and frustrated that more “real” people, more consumers are not sticking their necks out and standing up for one another….standing up to save this country….but I’m proud that there are lawyers out there like Chip Parker who are willing to step up and speak out….FOR ALL OF US….

Fraud on The Court? Case Dismissed!

All across this country some judges have become numb to the fraud that is being committed in their courtrooms. Some judges are afraid to call it what it is and to be direct and clear about the seriousness of the violations.
The order found here shows what happens when a judge “gets it” after a good attorney has done his job to document the issues that are presented. What’s most disturbing about this is the fact that I believe there could be thousands perhaps tens of thousands of these orders that could be issued every day. I hope that our elected circuit court judges will begin to take serious note of such issues and begin to start issuing more orders like this.
Local News Affiliate Reports Mortgage Services Company Under Federal Investigation
One thing we’re all just beginning to understand is just how deep this foreclosure problem is. Much is uncertain, but this much is clear…the banks, lenders and mortgage companies, in their rush to make obscene profits, engaged in an international orgy of reckless conduct. They were all so busy pushing consumers, closing loans and selling them up the river and shoving money in their pockets that they ignored “minor” details like keeping a proper paper trail or developing business infrastructure to manage the multi bajillon dollar glass houses of lending and trading they created.
Now that this has all surfaced, their response to the problem is to cut even more corners and engage in even more reckless and risky conduct as they push through foreclosures. The manifestation of all this are document mills, foreclosure mills and “robo signers” who are all working day and night to create the paper trails that should have existed long ago. Defense attorneys caught onto this, circuit court and bankruptcy court judges are now learning about it and finally, so are federal investigators.
