Bondi’s Motion For Certification Is Bad News For Lawyers, Our Courts And The Practice of Law…..

stern-foreclosures4ClosureFraud posted an entry which cheered Florida’s AG Pam Bondi for finally taking some action on the fraudclosure front.  Two newspapers picked up the story and I did a post on it.  We all thought the Petition meant something…but it doesn’t. The law is well settled…and it’s very, very bad law…..lawyers and law firms are immune from prosecution for unfair and deceptive practices.  Asking the question posed to the Supreme Court at best is going to receive a very swift, “Lawyers Are Exempt” response.  A response such as this is going to be very much like a hot poker shoved in the eye of the citizens who are suffering as part of this mess.

Now maybe the Supreme Court will take the position of Captain Obvious and tell the Attorney General…you’ve got a whole lotta other targets you could be going after.  Like LPS…they’ve been in the news lately or David J. Stern Enterprises, they have not been in the news lately but should be.  DJSP was a bad deal from the outset, and the evidence is laying all around.  It’s in federal court cases. It’s in documents filed with the Securities and Exchange Commission. It’s in depositions filed right there with the Florida Attorney General’s Office.

And so now that I’ve had a day to think about Bondi’s Motion, I feel suckered.  The Motion itself lacks any substance and is not supported by the case law and examples that are necessary to make it a compelling legal document.  I’m afraid it’s going to elicit a wet towel response from the Supreme Court and that’s only going to make citizens even angrier with lawyers than they already are.  I don’t want that. I want lawyers and courts and my profession screaming, “DAMN THE TORPEDOES, WE’RE GONNA SOLVE THIS!” In the midst of this crisis I want to general public to see lawyers as the defenders of their rights and the defenders of the Rule of Law, stepping into the mess that the banksters created and shoving some justice and integrity down their monstorous throats….

That’s what Florida’s lawyers should be doing….not filing tepid motions that will lead nowhere.

The Florida Bar Weighs in On Fraudclosure Gate….sortof

foreclosure-noteA great, long and fairly non-committal article on the profound crisis called fraudclosuregate appears in the new edition of the Florida Bar News…I think the Bar Journal article takes the same tone expressed by nearly every party in a position of power, which is to say, it’s sort of a shoulder shrug, head tilted sideways and vacant expression of,

“so what are we ‘sposed to do?”

Apparently, punishing systemic wrongdoing is not part of the discussion. Oh well, a few highlights from the article:

“If you know what you’re looking for, you can find the fraud on the face of the document. It’s systemic,” said April Charney, a Jacksonville Area Legal Aid attorney and acknowledged expert on foreclosure defense. “It’s like paperwork HIV; everyone has the same virus because it was so systemic.”

Michael Redman, a founding member of 4closurefraud.com, a citizen group based in Palm Beach County that helps homeowners fight foreclosures, said there’s no difficulty finding defective paperwork. “The real question is what is the percentage that’s not affected,” Redman said. “I would say it’s in the high 90 percentile that all of it was affected up to early this year.” Despite claims by major banks that they have overhauled their foreclosure paperwork preparation, “I’d say it’s still questionable,” he added.

There has been no formal study of foreclosures filed in Florida to determine the extent of the paperwork problems, but the Attorney General’s Office has undertaken several investigations of law firms and private companies that prepare foreclosure documents. Jennifer Krell Davis, press secretary for Attorney General Pam Bondi, said 11 investigations have been started, and one of those, against a law firm, has been settled.

Bank of America Suspends Foreclosures- Federal Moratorium to Follow

WSJ-foreclosure-weidnerSearch back on this blog and sites like 4Closurefraud.com and Foreclosurehamlet.com.  We’ve been arguing for months now that the only legitimate response to the foreclosure crisis is a moratorium.

Our so called state and national “leaders” have not yet taken the chance to show real leadership and do such a thing, but the lenders that caused all this mess are implementing moratoriums on their own.

Type the word “Moratorium” on this blog and see how long I’ve been arguing for it.  Now, when the title claims start rolling in.  When the title underwriters cannot handle their claims.  When the losses for the banks and insurors cannot be covered without a bailout, just calculate how many billions would have been saved if the moratorium would have been implemented back when we all started screaming for it.

Just something to think about.

THIS MAKES ME SO ANGRY I CAN’T STAND IT- Transcript that details a “Rocket Docket” (Foreclosure Gas Chamber)

For those of you, especially those in the press, that have been asking what a Rocket Docket is and what the problems with the Rocket Docket are, I want you to read the attached transcript which was just released from a “hearing” held in Palm Beach County.

The transcript lays out the problem- a huge foreclosure backlog that has clogged the docket.  Note the near panic in the judge’s voice and the comments about courtroom overcrowding and the fire marshal.  The judge acknowledges that most who are there, and especially the defense attorneys, seek to have the Summary Judgment denied.  The first case out of the box illustrates about a clear an example of when Summary Judgment should be granted, but then the court just goes ahead and grants Summary Judgment anyway.

This is all just a tremendous miscarriage of justice all in the name of expediency on behalf of failed lenders and their foreclosure mills….this should never, ever happen, but apparently it happens every day, all over the state and especially in Palm Beach County.

WHERE IN GOD’S NAME IS THE PRESS ON THESE ISSUES?

How about our federal and appellate courts and Attorney General examining not just the technical issues in each one of the cases, but examining the fundamental violations of substantive Constitutional rights because Rocket Dockets do not provide important Due Process protections?
