EMERGENCY- FLORIDA (un)Fair Foreclosue Act On The Move!
It looks like the Florida House of Representatives will move on Wednesday, February 8 to hear the Florida (un)Fair Foreclosure Act.
The bill number currently under consideration is Committee Substitute for House Bill 213. Please take the time to read the bill in full here.

It is expecially important to call the chairperson Dorothy Hukill and make sure she knows this is a bad, bad bill:

But make sure you hit all the legislators on the committee. They need to know that this bill it toxic and will be very, very controversial. It is still being amended and more bad news is being thrown into this every day. The bottom line is it is a reward to the banksters that caused all this mess, paid for by the little guy.
Among the most disturbing aspects is that it would turn some foreclosures into “show cause” proceedings that could deprive a homeowner of the right to raise defenses and could result in a sale in as little as 90 days!
The bill would require some Defendants to make payments to the pretender lender as a condition of having their voice heard in court.

The Top Story Not Told in 2011…They Won’t Tell How Bad Housing Numbers Are
I’m writing that FIRE will burn in 2012. The working thesis is that all the lies and the fraud and the abuse that have been visited upon the American middle class over the last several years will finally ignite a very powerful blowback. We are just now starting to see some sparks as people wake up and begin to resist the attacks and question the prevailing political, social, economic and legal theories that are utterly unworkable in this new environment.
What’s most disturbing to me is the lack of truthful or accurate information for individuals to rely upon. Two examples that are of particular concern to me are the National Association of Realtors and the admission that their sales numbers were completely wrong and the widely-published numbers from RealtyTrac which I think are dead wrong. The RealtyTrac numbers always felt out of whack, but I never really dug deep into them before an article was published in the St. Petersburg Times, with the headline:
SECOND WAVE OF FORECLOSURES COMING!
But immediately after I hung up the phone with the reporter, I looked at the actual foreclosure numbers at the courthouses and found that the RealtyTrac numbers were all wrong. Now, I don’t know the methodology or the context of the numbers, but the information was just wrong, wrong, wrong…..and this is repeated over and over again all across the country. It was as if Paul Revere came riding through town screaming his head off like a madman but he was twelve months too early….
Which brings us to the story that ran in the Palm Beach Post yesterday, their Top Stories of 2011 Their number two story of the year is the continuing problems related to foreclosure. Here’s the headline for 2012:
“We’re nowhere near the level of foreclosures that could be filed based on the number of loans in default.”
Florida foreclosure defense attorney Matt Weidner said in November.
Florida Rep. Greg Stube- House Bill 1149- The Begining of Real Foreclosure Reform?
The Florida Legislature has got to do something about foreclosures and the (un)Fair Foreclosure Act of 2012 ain’t it. This piece of legislation has some positive elements in it…..it deserves review and consideration.
Importantly, the Representative Greg Stube deserves our attention and support because he is clearly listening to a whole variety of sources and does not appear to be an activist for the banks. This is a good starting point and we should all reach out to someone who is actually listening:

Mark Stopa is a great attorney and I appreciate his guidance on appellate matters. It just so happens that we have two different appeals pending against the banksters who just cannot stand the fact that the Florida Supreme Court wants them to play by the rules, investigate the lawsuits they are filing and treat the court system with some basic respect.
It just so happens that in this area of the state, on the west coast of Florida where I am most familiar, the trial court judges treat these foreclosure cases like every other case, forcing both sides to go through their paces, fight for every single point and issue….AND FOLLOW THE RULES!
Well, the banksters don’t like the rules so they continue to fight, every single step of the way.
I love the way Mark takes their appeal and shoves it right back in their face…in his particular case, the banksters taunted the judge then threw the appeal right back at them…..make sure to read his Answer Brief……
